Thank you for your interest in tutoring for my company, Champion Tutors.

 

My name is Lorne Jones, and I have been providing Canadians with tutors since 1998. I have also been providing high-achieving high school students, post-secondary students, graduates, teachers, and professionals with an avenue to share their knowledge and “top up” their income with convenient and flexible hours and working conditions.

 

Basically, I find clients and then match them to you based on your skills, availability, and ability to travel (20 minutes or so via car, close to home or a library if you are not mobile or a bus-rider).

 

I also match them according to your expected wage. Ask for what you feel you are worth and what would motivate you, but try to match what the market will bear. If you are not competitive, I will not be able to send you clients.

 

You will be called as needed, and are always welcome to decline. However, if I make you an offer and I do not hear from you, it is not likely I will make you another.

 

Your responses to the following will better help me help you find clients suitable for and close to you.

 

Please note that the more versatility you possess (i.e. the more subjects you can tutor), the busier you will probably be. This is especially true in the English/Language Arts; in other words, most markets will limit you if this is your only subject.

The Canada Revenue Agency has determined that people who tutor for my company do so as independent contractors, so I do not need or want your SIN or banking information, nor do I need to make deductions from your cheques for CPP, EI, and Provincial/Federal Tax. They ask that you report this as “additional income” on your tax return. For most people, this additional income does not change their tax bracket.

 

The CRA doesn’t care how old you are, and neither do I, but I do prefer high school tutors be 16. There is a chance, then, that you drive, but this age allows me to comply with labour laws in all provinces. Please note that if you are not 18, I will want to speak to your parents the first time I offer you a contract/client.

 

Because you and I will communicate only via e-mail or telephone, I need to ask the following questions in order to get a sense of who you are. Also, clients occasionally want to know these things before they consent to having you work with their children, especially in their homes.

Also please remember that this is “top-up” income, money to supplement your regular work and studies. I cannot give you enough hours to equal a full-time or even part-time job.

 

Ask for what you feel you are worth, for what will keep you motivated and happy, and I will add a bit (which might or might not equal 40% of the total I ask of clients).

 

If you don’t hear from me within three months, consider reapplying and 1) broadening your subjects and 2) reconsidering your rate (other tutors are beating you for jobs because they are more versatile or more competitive).

Champion Tutors Independent Contractor Agreement SAMPLE (Do NOT Complete This Version)

This agreement will guide our business relationship. If you have any questions about its content, please ask for clarification, but please also understand that years of experience have determined what should be in it. When I have a client that you accept, an agreement with particulars will be sent to you. Everything in it is open to negotiation.

The Tutor:

 

 

After you have accepted the contract:

1)      call me if you have any questions about this document;

2)      call the Client to ensure that the Client, the Student, and the subject(s) are acceptable to you;

3)      if you are comfortable with the match, make an appointment with the Client and Student;

4)      inform me via e-mail of when this meeting is to take place;

5)      all sessions are to take place at the Client’s home or a suitable Public Location (the Client’s choice);

6)      meet the Client and Student(s);

7)      collect from the Client the Client’s Agreement (which I will have e-mailed to the Client) and our payment from the Client, insuring Client’s name, address, and phone number are on the cheque(s), that it is/they are issued to Lorne Jones, and that the amount(s) and date(s) is/are as follows: (she will probably pay via money transfer)

Do not perform more hours than the clients have purchased. Please track your hours via the timesheet and notify me when the client’s original purchase is concluding, preferably with a cheque from them for more hours.

 

I cannot pay you for any unauthorized hours until the client pays me, so please be diligent in this regard.

 

 

Please send the client’s cheques promptly so 1) clients do not worry that their sensitive financial information has been lost and 2) I can endorse their cheques as quickly as possible so that I am relatively certain of the client’s ability and willingness to pay.

 

I have a safe and secure Post Office Box. If you address these cheques properly, they will get to me safely and securely. If you are concerned about this, you are welcome to register your letter at your own expense. I will then have to sign as proof of receipt.

 

Please include your return address on your envelop just in case, and please fold the cheques in papers for privacy and security.

 

If a client’s cheque is, or is going to be, NSF (Not Sufficient Funds), I want to know this as soon as possible so I can take action. If you cause me to delay this action by not mailing their cheques promptly, you might cause an unnecessary delay in your share of the contract. (If extenuating circumstances erupt, please e-mail me about them.)

 

 

8)      collect the Client’s agreement and mail immediately, via regular letter unless you desire to pay for another method, with the cheque(s); Please have the clients place their e-mail address on the front of their first cheque;

9)      tutor; all sessions will be, or count as, a minimum of 1.5 hours; denote session times and have the Client or Student initial in the appropriate area;

10)  I encourage you to seek the client’s agreement that sessions be longer, especially for older students in complex subjects. 1.5 hours is ideal;

 

11)  Your payment for this Client shall be $xx.00 per hour tutored, with no deductions for EI, CPP, etc. (the Canada Revenue Agency considers you an Independent Contractor);

12)   A Note About Pay: I want to be able to pay my considerable expenses and stay motivated to remain in business to contract with you in the future. I hope you value my hard work in making jobs appear in your e-mail box and that you feel a “60% for you, 40% for me” split is fair, although I do not have the percentage carved in granite.

 

13)  issue a brief (2 to 4 sentence) report card after every tenth hour, unless the student is in post-secondary;

14)  submit your time sheet according to your wishes: after every hour, every fifth hour, or after every tenth hour; but within ten days of the last hour for which you seek payment; I prefer every tenth hour so that I am not issuing cheques on behalf of our clients every night; please note that I holiday in July, August, and December;

17)  do not, under any circumstances, accept cash from the Client or cheques made to you: doing so could put you and the Client in contravention of several Canada Revenue Agency and Federal or Provincial Employment Standards regulations, the penalties for which can be severe;

 

18)   Non-Competition Clause: By having discussed and read this offer of employment, you have received proprietary information about clients, and you are agreeing not to tutor this client or anyone in this client’s immediate family or circle of friends, unless via contract with Champion Tutors/Mr. English, for five years after the date of the last session with this client (or the date of this offer, if you choose to decline it).
